North Corfu’s Seasonal Lodging Policy Deemed Lawful: A Test for Transparency or a Burden on Business?
The North Corfu Municipal Council’s decision to introduce a stringent new framework for the seasonal operation of tourist accommodations has been officially deemed lawful. This ruling, issued by the Decentralized Administration of Peloponnese, Western Greece, and the Ionian on January 13, 2026, concludes a significant administrative process that has sparked considerable discussion within the Greek tourism industry, particularly concerning the issue of seasonality in tourist businesses.
A New Era of Transparency and Control?
As exclusively revealed by Money & Tourism on December 4, 2025, the Municipal Council unanimously approved on November 28, 2025, a comprehensive set of documentation and rules governing the seasonal status of hotels and rental accommodations. This new regulation aims to ensure complete transparency, uniformity, and clear oversight of businesses declaring seasonal operation.
The decision fully adopted the proposal from the Seasonality Control Committee, establishing an extensive package of 17 required documents. This process is now significantly more rigorous and detailed, demanding:
- A solemn declaration with full operational details and a commitment that facilities will not operate outside the declared period.
- A technical report from an engineer, meticulously detailing square footage and usage.
- An operating license or business commencement certificate.
- Previous year’s VAT declarations.
- Tax and municipal clearance certificates.
- Electricity bills demonstrating non-operation during off-season.
- Data from the Hellenic Chamber of Hotels (XEE) and the Greek National Tourism Organization (EOT), where applicable.
- Guest book, staff roster, General Commercial Register (GEMI) documents, and Chamber of Commerce certificates.
The committee explicitly states that any repair or maintenance work within a business will be considered operational time, thus disallowing it from being declared as a period of seasonal suspension.
Strict Deadlines and an End to Loopholes
For the first time, the Municipality is instituting exclusive and non-negotiable deadlines for submitting applications:
- For seasonality commencing November 1: from August 1 to September 30.
- For seasonality commencing October 1: from July 1 to August 31.
“Applications will not be accepted beyond these deadlines,” the decision explicitly states. This regulation is expected to curb instances of late or incomplete applications and streamline administrative control and planning.
The Decentralized Administration’s Verdict
According to the Decentralized Administration’s decision, Municipal Council Resolution No. 17-151/28-11-2025 was reviewed as part of the mandated legality checks for Local Government Organizations and their compliance with existing legislation. The review specifically focused on the eligibility of tourist accommodations for seasonal operation and related municipal fees, such as those for cleaning and lighting.
With the completion of the review and the confirmation of the decision’s legality, any administrative ambiguities are removed, providing a clear institutional framework for tourist businesses operating in North Corfu. This development ensures that seasonality will be implemented according to legal provisions, free from legal or administrative impediments.
This particular decision holds significant importance for local tourism, as it regulates issues directly affecting the year-round operation of accommodations. It also contributes to a clear delineation of business obligations to the municipality and better planning for municipal services, which must adapt to the fluctuations in tourist traffic characteristic of the region.
The legitimization of the decision enhances administrative security for both the municipality and tourism professionals, creating a stable framework ahead of the tourist season and clarifying the implementation of seasonality for tourist accommodations in North Corfu.
Legal Precedent and Industry Backlash
The Decentralized Administration’s decision creates new facts and is expected to provoke reactions from hotel industry stakeholders. According to law, the procedure for classifying a business as seasonal has been outlined since 2007 in Circular 78/71251/19-12-2007 of the Ministry of Interior. This circular stipulates that entrepreneurs only need to submit:
- An Application-Solemn Declaration under Law 1599/1986.
- A detailed report of operational spaces and duration.
- A declaration of changes when the operating period increases or decreases.
There is no mention of additional supporting documents, nor does it foresee the imposition of further requirements by Municipalities.
In this context, and following Money & Tourism’s exposé, the Panhellenic Federation of Hoteliers (POX) sent a letter to the relevant authorities requesting intervention. The letter, previously published by Money & Tourism, highlighted concerns about municipalities that either fail to apply the relevant legislation or interpret it according to their own discretion, leading to financial or bureaucratic burdens on businesses.
POX specifically cited the North Corfu Municipality’s requirement of 15 (now 17) documents for
